1.0 Non-refundable deposit
A non-refundable 50% deposit of the tour price is required for the booking to go ahead and can be paid through a secure i Zettle payment link. The balance must be paid by the day before the tour date.
2.0 Cancellation
Cancellation of a tour by the client must be made by email or text message no less than 48 hours before the tour date. Cancellation within 48 hours of any tour commencing will be treated as the tour being fulfilled and no refunds will be given unless the tour is cancelled because of extreme weather in which case an alternative date/time will be offered immediately by the driver/guide. For tours where vehicle hire and accommodation are required to be booked in advance, Wynding Road Tours requires 28 days-notice of cancellation. A refund will be given minus expenses occurred by Wynding Road Tours when hiring vehicles/accommodation.
3.0 Acceptance of a booking
Payment of a deposit does not imply acceptance of a booking. Wynding Road Tours will confirm acceptance of a booking in writing after which a contract comes into existence between Wynding Road Tours and the client.
4.0 Winter timetable
A winter timetable will operate from 21st October 2024 to 21st March 2025.This will involve an earlier start time of 8.00am and an early finish time of 5.00pm. In addition, for safety reasons all tours will aim to be off all Highland roads before sunset.
5.0 Our right to alter or cancel tours
Wynding Road Tours reserves the right to alter or cancel any tour. Should an alteration or cancellation become necessary, the client will have the choice of accepting the change, taking an alternative tour or withdrawing from the contract and accepting a refund of all monies paid to Wynding Road Tours including any deposit. Exceptions to this is Force Majeure, defined as unusual and unforeseeable circumstances beyond our control, such as war or the threat of war, riots, terrorist activity, civil strife, industrial disputes, natural or nuclear disaster, fire, flood or adverse weather condition.
6.0 Guide/driver inability to attend
In the event of the specified tour guide/driver being unable to attend due to illness or other circumstances beyond our control, another tour guide/driver will be provided. If this is not possible, then the tour will be cancelled and a refund provided.
7.0 Our right to make changes
We reserve the right to change any of the prices, services or other particulars contained in these terms and conditions at any time before we enter into contract with a client. Any change will be notified to the client before a contract is agreed.
8.0 Client special requests
If the client has any special dietary or other requests they should inform Wynding Road Tours of these prior to departure date. Wynding Road Tours will advise the relevant supplier of your requirements, but we cannot guarantee that such requests will be met and will have no liability to the client if such requests are not met.
9.0 The nature of our tours
The tours Wynding Road Tours offer require flexibility and must allow for alternatives. For this reason the outline itinerary and tour description must be taken as an indication of what may take place on the tour and not as a contractual obligation on the part of the company.
10.0 Liabilities
Wynding Road Tours does not accept liability for any loss or additional expense caused by delay or interruption to travel services through weather conditions, civil disturbance, industrial action, strikes, wars, floods or sickness. Such losses or additional expenses are the responsibility of the client.
11.0 Our responsibilities
Wynding Road Tours accepts responsibility for acts and /or omissions of its employees (whilst acting in the course of their employment). The Company does not accept responsibility or liability for death, bodily injury or illness caused to the client or any other person included on the booking form unless arising from the negligent act and/or omission of the Company’s employees (whilst acting in the course of their employment). Any claims shall be subject to Scottish law in respect of any question of liability or quantum and all proceedings shall be within the exclusive domain of the Scottish courts.
12.0 Complaints
The client must communicate any perceived failure in the performance of this contract immediately to the tour leader thus giving the tour leader the opportunity to achieve a satisfactory solution. Should this not be possible, the client should make their complaint known to Wynding Road Tours in writing within 28 days of the completion of the tour.
13.0 Client responsibilities
It is a term of the contract between Wynding Road Tours and the client that the client will obtain the appropriate travel insurance cover before commencing the tour (whether abroad or in this country). The insurance must cover the loss, expenses and damages arising from (including but not limited to) the cancellation of the tour (whether in whole or in part), personal accident and injury, medical and repatriation costs (for overseas tours), loss of baggage and personal money and belongings and flight cancellations and delays.
14.0 Incomplete service
In the unlikely event that Wynding Road Tours becomes unable to provide a significant proportion of the services the client has booked (after tour starts), Wynding Road Tours will make alternative arrangements at no extra charge or if this is impossible will provide transport back to the point of departure and a pro rata refund for the cost of the remainder of the tour.15.0 Client acceptance of terms
By paying the deposit the client is agreeing to accept all the above conditions. The person paying the deposit agrees to accept the terms and conditions on behalf of all the individuals included on booking form.
16.0 Review of these terms & conditions
We may update our terms & conditions from time to time as necessary. The terms that apply to you are those posted on the website on the day you use it.
